My name is Carla Mendez. I spent ten years working in HR and workforce compliance — first as an HR specialist, then as an HR manager at a mid-size manufacturing company in Ohio. The core overtime calculations are based on the Fair Labor Standards Act as interpreted by the U.S. Department of Labor's Wage and Hour Division. The regular rate of pay formula — the one most online tools get wrong — is implemented per 29 CFR Part 778, the Code of Federal Regulations section that governs overtime compensation under the FLSA. This is not a summary or an approximation; it's the actual regulatory language that governs how overtime must be calculated for hourly non-exempt employees in the United States.

State-specific rules, including California's daily overtime and double-time thresholds, are verified against the applicable state Department of Labor or Labor Commissioner publications.
